Welcome to ClapBack ("we," "our," or "us"). By downloading, installing, or using the ClapBack mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using ClapBack, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and ClapBack.

2. Description of Service

ClapBack is a mobile application that uses artificial intelligence to generate comebacks, roasts, and responses based on user-provided text conversations or screenshots. The App offers both free and premium subscription services.

3. Age Requirements

You must be at least 13 years of age to use ClapBack. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent and warrant that you meet these age requirements.

4. User Responsibilities

You agree to use ClapBack responsibly and in accordance with these Terms. Specifically, you agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or harm others using content generated by the App
  • Upload or share content that is defamatory, obscene, or violates others' rights
  • Attempt to reverse engineer, decompile, or extract the App's source code
  • Use automated systems or bots to access the App
  • Share your account credentials with others
  • Use the App to generate content for commercial purposes without authorization

5. Content Moderation

While ClapBack uses AI to generate responses, you are solely responsible for how you use the generated content. We do not endorse or take responsibility for how you use the comebacks or responses generated by the App. You agree to use generated content responsibly and in compliance with applicable laws.

6. Subscription Services

ClapBack offers a free tier with limited generations per day and a premium subscription ("Pro") with unlimited generations and additional features. Subscription terms include:

  • Free Tier: 3 generations per day
  • Pro Subscription: Unlimited generations, access to all response styles, and History feature
  • Subscriptions are billed through your App Store or Google Play account
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can cancel your subscription at any time through your device's subscription settings
  • Refunds are subject to the policies of Apple App Store or Google Play Store

7. Intellectual Property

The ClapBack App, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

Content generated by the App is provided for your personal use. You retain ownership of any original content you provide to the App, but grant us a license to use such content to provide the service.

8. Third-Party Services

ClapBack uses third-party services, including OpenAI's API, to provide AI-generated responses. Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability, accuracy, or content of third-party services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP OR GENERATED CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAPBACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Termination

We reserve the right to suspend or terminate your access to ClapBack at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ClapBack operates, without regard to its conflict of law provisions.
